1.2. Aceptación y vigencia de las condiciones generales y particulares

Tanto la navegación como la utilización y/o pedido de cualesquiera de los productos ofrecidos en esta página Web le atribuye a Ud. la condición de Usuario y supone su aceptación plena y sin reservas de todas y cada una de las Condiciones Generales y, en su caso, Particulares vigentes en el momento en que Ud. como Usuario acceda a la página Web.

LODOS DEL MAR MENOR, S.L. se reserva el derecho a ampliar y modificar unilateralmente, en cualquier momento y sin previo aviso, la presentación, configuración y contenidos de la página Web, así como suspender temporalmente la presentación, configuración, especificaciones técnicas y servicios del sitio web, de la misma forma.

2. CONDICIONES GENERALES DE USO DEL SITIO WEB

2.1. Obligaciones de uso

Con carácter general, el Usuario se obliga al cumplimiento de las presentes condiciones y términos de uso, y obrar siempre conforme a la ley, a las buenas costumbres y a las exigencias de la buena fe, empleando la diligencia adecuada a la naturaleza del servicio del que disfruta, y absteniéndose de utilizar el presente sitio web de cualquier forma que pueda impedir, dañar o deteriorar el normal funcionamiento del mismo, los bienes o derechos del titular LODOS DEL MAR MENOR, S.L., del resto de Usuarios o, en general, de cualquier tercero.

En particular, y sin que ello implique restricción alguna a la obligación asumida por el Usuario con carácter general de conformidad con el apartado anterior, el Usuario se obliga, en la utilización del presente sitio web a:

LODOS DEL MAR MENOR, S.L. podrá, en todo momento y sin previo aviso, modificar las presentes Condiciones Generales, así como las Condiciones Particulares que, en su caso, se incluyan, mediante la publicación de dichas modificaciones en el sitio web con el fin de que puedan ser conocidas por los Usuarios.

2.2. Exoneración de responsabilidad

LODOS DEL MAR MENOR, S.L. no será responsable:

• Con carácter general, respecto del uso inadecuado de su sitio web. Los usuarios deberán realizar un uso adecuado del mismo, de acuerdo con las condiciones y términos anteriores, sin que ninguna responsabilidad pueda tener el titular por la utilización indebida.

• Respecto de posibles deficiencias técnicas LODOS DEL MAR MENOR, S.L. no será responsable en ningún caso de las alteraciones en el servicio que se produzcan por fallos en la red eléctrica, en la red de conexión de datos, en el servidor o en cualesquiera prestaciones.

• Respecto al acceso por terceros a su sistema. LODOS DEL MAR MENOR, S.L. adoptará las cautelas técnicas necesarias a fin de proteger los datos e información a la que se accede, pero sin que sea responsable de actuaciones de terceros que, vulnerando las medidas de seguridad establecidas, accedan a los citados datos.

• LODOS DEL MAR MENOR, S.L. invierte constantemente en medios tecnológicos que intentan minimizar el riesgo de virus y software similar, y contenidos no autorizados en sus sistemas de información. A pesar de ello, el Usuario es consciente de que debe adoptar sus propias medidas orientadas a minimizar los daños ocasionados por software no autorizado, virus, troyanos y cualquier clase del software denominado mal-ware, eximiendo a LODOS DEL MAR MENOR, S.L. de toda responsabilidad que pudiese derivarse de la contención de malware en los tratamientos habilitados en la presente web.

2.3. Utilización de hiperenlaces

El usuario de Internet que quiera introducir enlaces desde sus propias Webs a la Página Web deberá cumplir con las condiciones que se detallan a continuación sin que el desconocimiento de las mismas evite las responsabilidades derivadas de la Ley. Los términos y condiciones que rigen este web site y todas las relaciones que pudieran derivarse se encuentran salvaguardados por la legislación española.

Cualquier controversia que pudiera derivarse del acceso o la utilización de este web site será de competencia de los tribunales de Murcia.

The contracting and use of services with Lodos del Mar Menor S.L. (Hotel Lodomar Spa & Talasoterapia) imply the acceptance of these conditions, in which you declare and accept: to be of legal age (over 18 years old) and to have the necessary legal capacity to contract the services offered.

 

1. The reservation is guaranteed until 12 a.m. on the day of arrival. If you are going to arrive later, please call the hotel. Otherwise, the hotel may cancel your reservation.

2. Reservations for direct payment at the hotel must be guaranteed with a credit card or a deposit.

3. The ID card/passport of all persons staying at our establishment must be presented upon arrival.

4. The minibar in all rooms will remain empty, but will be connected to the power in case any guest wishes to use it.

5. The apartments do not have lifts and can either be ground floor or first floor.

6. Child discounts are subject to proof of age on arrival at the hotel (ID card, family book or passport).

7. Baby: 0 to 2 years in cot. Cot on request. It is necessary to confirm availability with the hotel at the time of booking.

8. Child: 3 to 12 years old. They will always share a room with at least one adult.

9. The room is available from 2 p.m. on the day of arrival until 12 p.m. on the day of departure.

10. The apartments have the following opening hours: - High occupancy season (from June to September, both inclusive, Easter, May Bank Holiday and Constitution Bank Holiday): from 3 p.m. on the day of arrival until 11 a.m. on the day of departure. - Rest of the seasons: from 2 p.m. on the day of arrival until 11 a.m. on the day of departure.

11. The apartments are equipped with kitchen utensils and linen, but ALL personal hygiene and cleaning products (including cloths, dishcloths, sponges, etc.) must be provided by the guest.

12. The apartments will be cleaned before the keys are handed over. Sheets and towels will be provided and will be changed every 3 days. For stays of more than 7 nights, the apartments will be cleaned as usual after 7 days.

13. Special requests are not confirmed (number of rooms, floors, location, type of bed, etc.). They will be taken into account, but are always subject to the availability of the hotel.

14. The type of room reserved is indicated in the confirmation of your reservation and will be assigned upon arrival. If you would like a superior room or a room with a view, please check with the hotel for availability and supplement.

15. The confirmed rate is valid for the number of nights booked. In case of early departure, the hotel reserves the right to charge the total amount of the stay.

16. For stays in apartments: the establishment reserves the right to retain an amount as a deposit to cover possible damages. Once the condition of the apartment has been checked after departure, it will be returned.

17. The Restaurant offers the option of buffet. Drinks are not included in the meals. The hotel reserves the right to serve a varied menu in the restaurant or cafeteria when the number of diners is less than 30.

18. In case of booking treatments or packages that include Spa services we inform you that:

- The hotel will automatically assign times at the time of booking.

- In the event of not receiving any other indication from you, these will be the definitive times and it is the client's responsibility to arrive at the stipulated time, which will be confirmed at reception upon arrival at the hotel.

- The hotel will do its utmost to accommodate guests' requests, so it is important to communicate them as soon as possible to the Spa center.

- We remind you that for all Spa services (including the circuit) an appointment is required.

- To access the water area (Spa) it is compulsory to wear a swimming pool cap, flip-flops and swimming costume. It is recommended to use swimming goggles due to the high salinity of the water.

 

Payment terms

The hotel will request full payment of the reservation upon arrival, admitting Visa, Euro/Master Card, Red 6000 and Maestro credit cards. The reservation is guaranteed by credit card. In the event that the client does not appear at the hotel or cancel after the deadline, HOTEL LODOMAR will have the right to charge the expenses (see the cancellation policy).

* Standard Rate (payment in hotel): The hotel will charge in advance the first night of your stay, according to season. Specified below:

 

· For Hotel reservations: - If your reservation is for a date between the following: from 10/04/2023 to 01/06/2023, from 24/09/2023 to 30/12/2023, from 01/01/2024 to 27/03/2024, from 01/04/2024 to 30/05/2024 and from 22/09/2024 to 30/12/2024 the hotel will charge the amount corresponding to the first night 2 days before the arrival date.

- If your reservation is for a date between the following: from 02/06/2023 to 22/06/2023, from 03/09/2023 to 23/09/2023, from 28/03/2024 to 31/03/2024, from 31/05/2024 to 20/06/2024 and from 01/09/2024 to 21/09/2024 the hotel will charge the amount corresponding to the first night 3 days before the arrival date.

- If your reservation is for a date between the following: from 23/06/2023 to 02/09/2023 and from 21/06/2024 to 31/08/2024 the hotel will charge the amount corresponding to the first night 5 days before the arrival date.

 

· For Apartment reservations:

- If the reservation is for a date between the following: from 10/04/2023 to 01/06/2023, from 24/09/2023 to 30/12/2023, from 01/01/2024 to 27/03/2024, from 01/04/2024 to 30/05/2024 and from 22/09/2024 to 30/12/2024 the hotel will charge the amount corresponding to the first night 2 days before arrival date.

- If the reservation is for a date between the following: from 02/06/2023 to 22/06/2023, from 03/09/2023 to 23/09/2023, from 28/03/2024 to 31/03/2024, from 31/05/2024 to 20/06/2024 and from 01/09/2024 to 21/09/2024 the hotel will charge the amount corresponding to the first night 5 days before the arrival date.

- If the reservation is for a date between the following: from 23/06/2023 to 02/09/2023 and from 21/06/2024 to 31/08/2024 the hotel will charge the amount corresponding to the first night 7 days before the arrival date.

 

SPECIAL POLICY FOR RESERVATIONS FROM DECEMBER 31st IN HOTEL AND APARTMENTS:

The hotel will charge 100% of the amount of the night of December 31st 15 days before the date. This amount will not be refundable.

 

Cancellation policy

1. It is possible to cancel the reservation free of charge 2 to 4 days before the arrival to the hotel and 2 to 7 days if you book an apartment. Always subject to the conditions it includes according to season, and as long as you have not chosen the non-refundable rate.

2. If the reservation is cancelled outside the free cancellation period, the hotel will have the right to charge 100% of the first night.

3. No Show and Unexpected Departure: The hotel will charge 100% of the stay not enjoyed.

4. Any modification of date, number of nights reserved, or number of guests, may lead to a change in the rate.

 

For reservations of Spa treatments:

- Notifying at least 24 hours in advance at the time of service: no charges.

- In case of no-show 100% of the service would be charged. For treatments already included in the accommodation package:

- In case of no-show or requesting a change of time or date less than 24 hours in advance, the hotel does not guarantee availability.
